Acceptance of These Terms
Welcome to FaceRef.org, a creative tool for building facial structure references, perspective studies, and artist workflow assets. By accessing or using FaceRef, you agree to these Terms of Service. If you do not agree, do not use the service.
Eligibility and Accounts
You may need an account to access certain features. You agree to provide accurate information, keep your login credentials secure, and remain responsible for activity that happens under your account.
You must be legally able to enter into these terms in your jurisdiction. If you use FaceRef on behalf of a studio, school, or company, you represent that you have authority to bind that organization.
Using FaceRef
You may use FaceRef for lawful creative, educational, and professional purposes. You agree not to:
- misuse, disrupt, or interfere with the service or its infrastructure
- attempt to gain unauthorized access to accounts, systems, or data
- reverse engineer, scrape, or abuse the service beyond permitted use
- upload or submit content that infringes another person's rights
- use FaceRef to create illegal, deceptive, abusive, or harmful material
We may suspend or restrict access if we believe your use creates risk for FaceRef, other users, or third parties.
User Inputs and Generated Output
You may provide prompts, uploads, reference images, settings, and other materials while using FaceRef. You keep ownership of the content you submit, but you grant us the limited rights needed to host, process, transmit, and display that content in order to operate the service.
You are responsible for making sure you have the rights to any content you upload or submit. You are also responsible for reviewing and determining whether generated output is suitable for your use case, including commercial or publication use.
Photographs of Real People
Some FaceRef features generate new views of a character from an image you upload. When you upload a photograph of an identifiable person, you confirm that:
- the person is an adult, and
- the photograph is your own work or you have that person's permission to upload it and to generate new images from it.
You may not upload photographs of minors, and you may not use FaceRef to create images of a real person in a way that is sexual, defamatory, harassing, or intended to deceive others about what that person did or said. Uploaded source photographs are deleted within 24 hours; generated outputs remain available in your account history.
We screen uploads automatically and may refuse or remove any upload or output, and suspend the account behind it, where we believe this section has been breached.
Intellectual Property
FaceRef, including its interface, branding, software, models, workflows, and related materials, is owned by FaceRef or its licensors and is protected by applicable intellectual property laws.
These terms do not transfer ownership of the FaceRef service to you. Except where expressly allowed, you may not copy, resell, sublicense, or redistribute the service itself or any protected part of it.
Paid Plans and Billing
FaceRef may offer paid plans, subscriptions, or other paid features. When you purchase a paid offering, you agree to pay the fees shown at checkout and any applicable taxes.
If a plan renews on a recurring basis, you authorize the recurring charges associated with that plan until it is canceled. Failure to pay may result in suspension or loss of access to paid features.
Privacy
Your use of FaceRef is also subject to our Privacy Policy, which explains how we collect and use information related to the service.
Availability and Changes
We may change, update, pause, or discontinue any part of FaceRef at any time. We do not guarantee that the service will always be available, uninterrupted, or error-free.
We may also update these Terms of Service from time to time. Continued use of FaceRef after changes become effective means you accept the updated terms.
Termination
You may stop using FaceRef at any time. We may suspend or terminate access if you violate these terms, create legal or security risk, or misuse the service.
Sections that reasonably should survive termination, including ownership, disclaimers, limitations of liability, and dispute-related provisions, will continue to apply.
Disclaimer
FaceRef is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.
Generated output may be imperfect, incomplete, or inconsistent. You should independently review outputs before relying on them.
Limitation of Liability
To the fullest extent permitted by law, FaceRef and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising from or related to your use of the service.
If liability cannot be excluded, it will be limited to the amount you paid to FaceRef for the service in the 12 months before the event giving rise to the claim.
Governing Law
These terms are governed by the laws applicable to the operating entity behind FaceRef, without regard to conflict-of-law rules. Any dispute will be handled in the appropriate courts or forums permitted by applicable law unless a different process is required by law.
